PeptoRat - Terms of Service & End User License Agreement

Black Rat Holdings LLC

Effective / Last Updated: September 6, 2026

1. Agreement to These Terms

These Terms of Service and End User License Agreement (the “Terms”) are a binding agreement between you and Black Rat Holdings LLC (“Black Rat Holdings,” “PeptoRat,” “we,” “us,” or “our”) governing your access to and use of the PeptoRat mobile application, websites, software, features, content, and related services (collectively, the “Services”).

By creating an account, accessing, installing, or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

2. Age Requirement — 18+

PeptoRat is intended for adults age 18 and older. You must be at least 18 years old to create an account or use the Services.

If we learn that an individual under 18 has created or is using an account, we may suspend or terminate the account and delete associated personal information as required or permitted by law.

3. Research-Use-Only Platform; No Medical Advice

PeptoRat is a research, recordkeeping, organization, education, and informational tool. PeptoRat is not a medical provider, pharmacy, laboratory, drug manufacturer, compounding pharmacy, or telehealth provider.

PEPTORAT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, TREATMENT, PRESCRIPTIONS, DOSING INSTRUCTIONS, OR EMERGENCY SERVICES. Information presented through the Services is for informational and research purposes only and is not a substitute for advice from a licensed healthcare professional.

Any reference to peptides, compounds, protocols, dosages, schedules, laboratory values, research materials, or user-entered information does not constitute a recommendation that a substance is safe, effective, approved, or appropriate for human use.

You are responsible for decisions you make based on information you enter, view, calculate, organize, or obtain through the Services. Always consult an appropriately qualified healthcare professional regarding medical questions, medications, symptoms, laboratory results, or treatment decisions.

4. Emergency Disclaimer

PeptoRat is not designed for emergencies and must not be relied upon for urgent or emergency medical decisions. If you believe you are experiencing a medical emergency, contact emergency services or an appropriate medical professional immediately.

5. Accounts and Security

• You must provide accurate account information and keep it current.
• You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account.
• You must promptly notify us if you believe your account has been compromised.
• You may not impersonate another person, create accounts through deceptive means, or use another person’s account without authorization.

6. User Content and Health Information

The Services may allow you to enter, upload, import, store, organize, or analyze information, including research records, compound information, notes, schedules, laboratory values, documents, health-related information, and other content (“User Content”).

You retain ownership of your User Content. You grant us a limited license to host, process, reproduce, transmit, format, and otherwise use User Content as reasonably necessary to operate, secure, maintain, support, and improve the Services, subject to our Privacy Policy and applicable law.

You represent that you have the right to provide any User Content you submit and that your use of the Services will not violate another person’s rights or applicable law.

7. Research Participation and De-Identified Data

PeptoRat may offer an optional research participation program. Participation is not automatic merely because you use a free or paid version of PeptoRat.

Where required, we will present a separate, clear consent describing the categories of data involved, the research or analytics purposes, whether information will be shared and with whom, and how you may withdraw consent for future use or sharing.

If you affirmatively opt in, we may create de-identified or aggregated datasets derived from eligible information in PeptoRat for scientific research, statistical analysis, safety and trend analysis, product development, publication of aggregated findings, and improvement of the Services.

We will take measures designed to remove direct identifiers and reduce the likelihood that de-identified information can reasonably be associated with you. We will not attempt to re-identify information that we maintain as de-identified except where permitted by law for purposes such as testing or validating our de-identification safeguards.

Withdrawal applies prospectively. Information already transformed into a dataset that is no longer reasonably linkable to you may not be technically capable of being identified and removed. Where applicable law gives you broader rights, we will honor those rights.

Research participation choices may be presented differently by plan, but we will not condition legally required privacy rights on payment.

8. Acceptable Use

You agree not to:

• Use the Services for unlawful, fraudulent, harmful, or deceptive activity.
• Use PeptoRat to prescribe, dispense, manufacture, sell, distribute, or facilitate unlawful distribution of controlled, prescription-only, counterfeit, or otherwise prohibited substances.
• Represent PeptoRat content as professional medical advice or regulatory approval.
• Attempt to bypass security, access another user’s data, probe vulnerabilities, introduce malware, scrape the Services in an abusive manner, or interfere with operation of the Services.
• Reverse engineer, decompile, or attempt to derive source code except where such restriction is prohibited by law.
• Copy, resell, sublicense, or commercially exploit the Services except as expressly authorized.

9. Third-Party Services and Content

The Services may link to, integrate with, or display information from third-party services. We do not control and are not responsible for third-party products, websites, laboratories, vendors, services, privacy practices, accuracy, availability, or content. References to third parties do not constitute endorsement.

10. Communications and Electronic Records

You agree that account, service, security, legal, and transactional notices may be delivered electronically. Marketing communications, where offered, are subject to applicable consent and opt-out requirements. You may unsubscribe from marketing messages using the method provided in the message, but you may still receive non-marketing communications necessary to provide the Services.

11. Subscriptions, Billing, and Refunds

If PeptoRat offers paid features or subscriptions, pricing and billing terms will be disclosed before purchase. Purchases made through an app-store platform may be billed, renewed, canceled, and refunded under that platform’s applicable rules. Unless required by law or platform policy, fees already paid may be nonrefundable. We may change pricing prospectively with notice as required by law.

12. Intellectual Property

The Services, including PeptoRat software, design, branding, interfaces, text, graphics, databases, and other materials provided by us, are owned by or licensed to Black Rat Holdings LLC and are protected by intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are transferred to you.

13. Copyright / DMCA

If you believe content available through PeptoRat infringes your copyright, send a notice containing the information required by applicable law to info@peptotrack.com, with the subject line “DMCA Notice.” We may remove allegedly infringing content and may terminate repeat infringers when appropriate.

DMCA contact: Black Rat Holdings LLC, 30 N Gould St Ste N, Sheridan, Sheridan County, WY 82801, United States; info@peptotrack.com.

14. Health and Safety - Assumption of Risk

You assume responsibility for how you use information in PeptoRat and for decisions concerning substances, products, research materials, supplements, medications, or protocols. Use of any substance may involve risks. PeptoRat does not verify that a user-entered substance is authentic, sterile, lawful, safe, properly stored, properly labeled, or suitable for any use.

15. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY.

We do not warrant that information is complete or error-free, that calculations or reminders will always be accurate, that the Services will be uninterrupted or secure, or that data supplied by users or third parties is correct.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACK RAT HOLDINGS LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICES.

Where liability cannot lawfully be excluded, our aggregate liability arising from the Services will be limited to the greater of the amount you paid us for the Services during the 12 months preceding the event giving rise to the claim or USD $50, except where a different limitation is required by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including rights available under applicable consumer-protection law.

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Black Rat Holdings LLC and its affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights.

18. Dispute Resolution

Before filing a formal claim, you and Black Rat Holdings LLC agree to attempt in good faith to resolve the dispute informally by written notice to info@peptotrack.com. Neither party will file a formal claim until at least 60 days after that notice, unless the applicable limitations period would otherwise expire.

For U.S. users, except where prohibited by law and except eligible small-claims matters, disputes may be resolved by binding individual arbitration under applicable arbitration law. Any arbitration or other proceeding will be limited to the dispute between you and Black Rat Holdings LLC individually; to the fullest extent permitted by law, you and Black Rat Holdings LLC each waive any right to pursue a dispute on a class, collective, or consolidated basis. No provision of these Terms is intended to waive a right or remedy that applicable law makes non-waivable, including any right to seek public injunctive relief where applicable.

Because arbitration and class-action provisions are jurisdiction-sensitive, Black Rat Holdings LLC should have this section reviewed by counsel before relying on it for launch or enforcement.

19. Governing Law and Venue

Except where consumer law requires otherwise, these Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. For disputes that may properly proceed in court, venue will lie in a court of competent jurisdiction in Wyoming unless applicable law requires another forum.

20. Export Controls and Sanctions

You agree to comply with applicable U.S. export-control and sanctions laws. You may not use or export the Services in violation of applicable trade restrictions.

21. Changes to the Services or Terms

We may modify the Services and these Terms prospectively. We will post updated Terms and revise the Last Updated date. Where required, we will provide additional notice or obtain consent. Continued use after an effective update constitutes acceptance only to the extent permitted by law.

22. Termination and Account Deletion

You may stop using PeptoRat and request account deletion. We may suspend or terminate access for material violations of these Terms, unlawful activity, security threats, or risks to users or the Services. Provisions that by their nature should survive termination remain in effect, including intellectual property, disclaimers, limitations of liability, and dispute provisions.

23. Miscellaneous

• Severability: If a provision is unenforceable, it will be modified or severed to the minimum extent necessary and the remainder will remain effective.
• No waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, reorganization, financing, or sale of assets, subject to applicable law.
• Force majeure: We are not responsible for delays or failures caused by events beyond our reasonable control.
• Entire agreement: These Terms and incorporated policies constitute the agreement concerning the Services, except where additional terms are expressly presented for a feature.
